President Donald Trump issued Executive Order 14352 on September 25, 2025. It defines a “qualified divestiture” as ending foreign-adversary control and preventing former affiliates from maintaining an operational relationship with TikTok’s U.S. operations. The order gives cooperation on the recommendation algorithm and agreements to share data as examples of such a relationship.

The White House determined that the proposed framework met the legal standard. TikTok announced on January 23, 2026, that TikTok USDS Joint Venture LLC had been established. TikTok describes the venture as majority-American-owned, with a seven-member board that is also majority American.

Ownership, U.S. data safeguards and global interoperability

TikTok says U.S. user data and the recommendation algorithm are secured in Oracle’s U.S. cloud. The company says the venture will retrain, test and update the algorithm using U.S. user data. It also says Oracle assists with ongoing source-code review and validation, while the venture has decision-making authority over U.S. trust-and-safety policy and content moderation.

TikTok also describes interoperability with global TikTok as part of the service. Interoperability allows the U.S. service to work with the global platform: TikTok says it helps U.S. creators reach international audiences and businesses operate globally. The company assigns interoperability and some commercial activities—including e-commerce, advertising and marketing—to TikTok global’s U.S. entities.

Reported coordination and North Dakota’s assessment

Reporting published October 9, 2026, described U.S. employees coordinating with global TikTok colleagues on features, dangerous trends and policies. It also described employees using Lark, a ByteDance-built internal communications system, and TikTok US’s Aime, an AI assistant built by ByteDance that operates inside Lark.

A spokesperson for North Dakota Governor Kelly Armstrong said the state’s information and technology office considered ownership, data security and independent oversight when North Dakota rescinded its government-device ban. The spokesperson said the office did not have access to TikTok’s internal systems.
