Spain’s revised data-center rules remain a proposal, but the reported threshold is higher: Reuters reported on October 26, 2026, that the Government of Spain would raise it from 1 MW in the earlier proposal to more than 10 MW. The initial draft measured its main threshold by electricity-network access capacity, while the reported revision’s threshold basis is not stated here.
What the original threshold measured
MITECO’s initial draft set its main threshold at at least 1 MW of electricity-network access capacity. Separately, it required information reporting from data centers with at least 500 kW of IT power demand. Grid access capacity describes a facility’s connection to the electricity network; IT power demand measures the power required by its computing equipment.
MITECO’s consultation page contains the initial draft. NeoTeo also covered Spain’s original data-center proposal.
Renewable timing in the reported revision
Reuters reported that the revised proposal keeps an 80% renewable share for every operating hour, with a conditional transition period of up to five years. It also reported that the qualifying renewable-installation window would expand from 18 to 36 months before a data center begins operating. Solar generation would have no time limit under the reported terms.
The proposal’s timeline
Reuters reported the revision on October 26, 2026. MITECO’s public consultation on the initial draft ran from August 27 through September 10, 2026, and the ministry marks it closed.
