Spain’s National Commission on Markets and Competition (CNMC) opened a new sanctioning proceeding against Apple and Amazon on Nov. 3, 2026, over alleged delays in complying with a 2023 order, RTVE, Expansión and El Debate reported. The case concerns conduct on Amazon Spain. Opening the proceeding does not decide whether the companies violated the order.
What the 2023 order covered
The order concerned restrictions on the number of Apple resellers on Amazon Spain, advertising for competing products, and marketing to customers who had bought Apple products. The reported €194 million combined penalty was imposed in 2023, not as part of the newly opened proceeding.
How the new proceeding developed
The companies removed clauses restricting reseller numbers and rival advertising in May 2025, according to the reports. In October 2025, the CNMC Council declared non-compliance and requested a new proceeding, according to Expansión and El Debate. Expansión reported that the CNMC had a maximum of three months to investigate and resolve the case.
What Apple and Amazon say
Apple said it disagreed with the CNMC’s decision and had always complied with the order. Amazon said it appealed the CNMC’s Oct. 1, 2025 resolution and disputed the regulator’s view that excluding sellers benefited Amazon. The company said its business depends on sellers’ success, most of them small and midsize businesses.
Expansión reported that, as of Nov. 3, 2026, appeals against the 2023 penalty and the 2025 non-compliance declaration were pending before Spain’s National High Court; courts had denied requests to suspend the decisions.
